In a written decision dated May 2, 2023, the Adjudication Tribunal found Rosemary Judd, Registration no. 21929 (the “Respondent”), guilty of conduct deserving of sanction under the Registered Nurses Act, 2008, subsection 18(c)(ii) professional incompetence in relation to an allegation filed by then, Eastern Regional Health Authority.
Decision Summary
The Allegation alleged that between the dates of 23 June 2018 and 28 December 2018 the Respondent failed to comply with the College’s Standards of Practice and the Code of Ethics respecting the duty to practice safely, competently and ethically; to practice using evidence informed knowledge skill and judgment; to be answerable for her practice; and to demonstrate reasonable knowledge, skill, judgment and/or concern for client welfare to an extent that client safety was placed in jeopardy. The Adjudication Tribunal accepted an Agreed Statement of Facts and accepted a Joint Submission on Sanction and ordered the Respondent’s license be suspended pending the provision of a medical report confirming the Respondent’s fitness to return to nursing practice; and a report from the Centre for Nursing Studies (CNS) confirming the Respondent has undergone an assessment by CNS and successfully completed any remediation recommended by CNS.
In addition, the Respondent must also successfully complete remedial education and submit a written reflection paper and meet with a College Nursing Consultant, Policy, and Practice to discuss the Reflection.
Following return to practice, the Respondent’s license to practice nursing shall be subject to the following conditions: that the Respondent’s practice be monitored by her employer in accordance with the employer’s discretion and that the College receive four reports regarding the Respondents nursing practice from the Respondent’s employer which must be in reference to at least the equivalent of three months of full-time employment and raise no concerns related to the Respondent’s practice competency.
The Adjudication Tribunal ordered that the respondent pay a portion of the costs incurred by the College in the investigation and hearing of the complaint.
On March 16, 2022, the practicing license of Rosemary Judd Registrant No. 21929, was suspended by CRNNL Council pending a hearing of the Adjudication Tribunal of the Disciplinary Panel.
