Decision Summary

In a decision dated October 2, 2023, the Adjudication Tribunal found Lenora Brazil, Registration No. 15217 (the Respondent), guilty of conduct deserving of sanction under the Registered Nurses Act, 2008, subsection 18(c)(ii) professional incompetence. The allegations alleged that the Registrant failed to meet the expected standards of practice of a registered nurse in that over the course of an employer implemented re-orientation period and observational assessment did demonstrate a pattern of conduct lacking reasonable knowledge and judgment to an extent that client safety was placed in jeopardy.

Specifically, the Respondent failed to follow the employer’s positive client identification policy; failed to follow proper medication administration practices; removed client records from the workplace contrary to employer policy; practiced independently despite being directed not to do so; failed to document in accordance with accepted best practice standards and employer policy; did not exhibit reasonable communication skills; and displayed lack of knowledge regarding instruction provided to clients.

The events of the Allegation, that the Respondent repeatedly demonstrated a lack of knowledge and understanding for the required standards of practice for a Registered Nurse, occurred while the Respondent was working in the Population and Public Health Program (Urban), then Eastern Health Authority.

In a decision dated October 2, 2023 the Adjudication Tribunal accepted an Agreed Statement of Facts and ordered that the Respondent’s license to practice nursing shall be suspended pending provision of a medical report confirming the Respondent’s fitness to return to nursing practice; provision of a report from the Centre for Nursing Studies confirming the Respondent has undergone an assessment and successfully completed any remediation recommended from said assessment. The Respondent must also provide a written self-reflection to the College and meet with the College’s Nursing Consultant, Policy, and Practice to discuss the Reflection.

Following the Registrant’s return to practice the Registrant’s practice shall be subject to monitoring by the employer for a period determined by the employer (minimum 12 months) and at least four quarterly Practice Monitoring Reports shall be provided to the College. The Registrant shall bear all costs associated with the requirements of the Adjudication Tribunal’s Order and shall be responsible for costs of the hearing payable within 12 months of the Registrant’s return to practice.
