On June 12, 2012, Mary Sloan, Registration No. 5885, met the terms of the Order of the Adjudication Tribunal dated January 16, 2012, such that the restriction on her practicing license as been removed. There is no longer a restriction on the Respondent’s practicing license with ARNNL.

On March 12, 2012, the practicing license of Mary Sloan, Registration No. 5885, was reinstated with restriction. The Respondent shall not work in Long Term Care, Home Care or Community Health. The restriction on the Respondent’s license shall be removed upon her successful completion of the courses set out in the Order of the Adjudication Tribunal dated January 16, 2012.

On January 16, 2012, an Adjudication Tribunal of the Association of Registered Nurses of Newfoundland and Labrador (ARNNL) found Mary Sloan, Registration No. 5885 (the “Respondent”) guilty of conduct deserving of sanction. Pursuant to section 28(3) of the Act, the Adjudication Tribunal ordered that the Respondent’s license be suspended for a five-month period, effective October 11, 2011, with the terms and conditions summarized as follows: (i) the practicing license of the Respondent will be restricted such that she shall not work in Long Term Care, Home Care of Community Health, and (ii) upon successful completion of identified courses, the restriction shall be removed.

Decision Summary

In the matter of a Complaint against Mary Sloan Registration No. 5885 (the “Respondent”), and a hearing of the Complaint pursuant to Section 25 of the Registered Nurses Act, 2008 (the “Act”); an Adjudication Tribunal of the Association of Registered Nurses of Newfoundland and Labrador (ARNNL) in a Decision dated January 16, 2012 found the Respondent guilty of conduct deserving of sanction pursuant to the Act, in particular, the following section:

The conduct deserving of sanction occurred during the period of March 2, 2008, and February 2, 2009, while the Respondent practiced in St. John’s, Newfoundland and Labrador. The Complainant was Eastern Health.

Pursuant to section 28(3) of the Act, the Adjudication Tribunal ordered that the Respondent’s license be suspended for a five-month period, effective October 11, 2011, with terms and conditions summarized as follows:

  1. The Respondent’s license to practice nursing shall be restricted such that she shall not work in Long Term Care, Home Care or Community Health; and
  2. The restriction on the respondent’s license shall be removed upon her successful completion of the following courses: Interpersonal Aspects of Nursing and Professional Responsibility.

The Adjudication Tribunal reserved on the question of costs and a separate decision will be issued in relation to costs.

On December 21, 2006, Mary Sloan, Registration No. 5885 (the “Respondent”) was found guilty of conduct that does not conform to the standards of the profession. The Disciplinary Panel overseeing the hearing ordered that the practicing license of the Respondent be suspended for a period of three months, from January 2, 2007 to April 2, 2007, and that during this period the Respondent is prohibited from practicing nursing in another jurisdiction.

On January 9, 2006, Mary Sloan, Registration No. 5885 (the “Respondent”) was found to be in breach of Sections 21(2)(b) and (2)(d) of the Registered Nurses Act. The Professional Conduct Review Panel ordered that the Respondent’s license be suspended for three months and that there are conditions to be fulfilled prior to the license being reinstated.

On October 9, 1999, the practicing license of Mary Sloan, Registration No. 5885, was reinstated. On July 14, 1999, the Disciplinary Committee found Mary Sloan, Registration No. 5885 (the “Respondent”), was in violation of Section 21(2)(a) of the Registered Nurses Act and guilty of breaching the Code of Ethics and ARNNL Standards 4.2, 4.3 and 6.1. The Committee ordered that the practicing license of the Respondent be suspended for two months, effective August 9, 1999, with a condition.
